DOES
ECC OWE YOU MONEY?
(1/2006)![]()
In November 2005, the General Union lodged a formal complaint at the Labour Standards Office (LSO) over unpaid overtime at ECC. The LSO has ruled that; yes, there is unpaid overtime at ECC, and that ECC must now pay teachers for this work.
This is a great victory but our new concern is that ECC has made no efforts to inform its employees or to actually pay anyone for their time worked. Nor have they posted notices in schools as promised to the LSO.
Therefore, the General Union will be sending a bill to ECC on behalf of union members for their unpaid overtime, and will follow up this claim with the LSO if ECC fails to pay.
The LSOfs decision regarding overtime covers the following groups:
1. Teachers whose last class and working hours end at the same time. Since this does not allow teachers to finish their work without working over their end time, this is overtime and must be paid. Do you have classes that end at the same time as the end of your shift?
2. No preparation time for the first class. For example, your first class starts exactly at the start of your working time. Do you have any days like this?
3. Staff who are pressured to clock out but to continue working. Are you in this situation? Are any of the staff at your school in this situation?
4. Also, we are considering a claim for non-payment of preparation time for Japanese part time teachers? Do you prepare outside of the period youfre paid for?
If you answered eyesf to any of these questions, you need to do the following?
1. Fill in the survey which can be found at www.generalunion.org/eccunpaidovertime.htm
2. Call the union to make an appointment so that we may investigate your claim.
3. Join, so that we may submit your overtime payment request with all of our members.
