General Union vs Osaka Shoin - Trial begins – Osaka District Court

On 31 March 2018 a General Union member was dismissed by Osaka Shoin High School specifically to stop him from working past a year and gaining the right to apply for an unlimited-term contract. On 25 June 2018, the member, with the aid of the union, filed a case against the dismissal at the Osaka District Court claiming the dismissal to be invalid.

After months of document exchanges in court, the case is set to come to trial on 3 February from 1310 to 1600 and we need you in court to support your fellow member and to show that we will not accept the dismissal of union members and employers who flaunt the law to get out of their obligations. Both our member (in Japanese with English translation) and a witness from Osaka Shoin will be examined and cross examined on the day of the trial.

Unlimited-term contracts are the law of the land, but that means nothing if employers can just stop these new contracts by firing you before you can even apply. It’s up to us to defend this important new law and let all employers know that this is unacceptable and will not be tolerated. Working at a board of education?

We will be holding an open meeting for all directly hired and dispatched teachers working at boards of education on Wednesday, 22 January from 1900 at the union office or via skype. Please RSVP if you plan to attend as seating is limited.

As you know, there are big changes taking place to the system for directly hired teachers starting in 2020 which may lead to jobs being outsourced or even cuts to wages. Dispatched teachers also face ever deteriorating working conditions which are often markedly worse than those working as directly hired teachers.

We don’t think that these two groups of workers should be fighting separately to improve their working conditions, but will have a better chance as dealing as one body especially in terms of how the General Union deals with ALT issues with the central government.

Survey of Over 1,700 Boards of Education

Two weeks ago, the General Union (in cooperation with our national union headquarters and sister unions) sent out a report to every board of education (BOE) in the country in regards to Assistant Language Teachers (ALTs).

As of September 13th (2019), we have received over 600 responses -much higher than our usual average in more limited surveys.

The survey follows the types of employment contracts for ALTs, illegal/improper dispatching, and - most importantly - what BOEs plan to do in regards to direct hire ALTs in 2020 when changes to the Local Civil Servants Law come into effect.

Union Sues Marist Brothers International School

On October 9th (2018), the General Union filed an application at the Osaka Prefectural Labour Commission suing Marist Brothers International School for their violation of the Trade Union Law.

The union had been trying unsuccessfully for a couple of months to get Marist Brothers to the collective bargaining table over their unfair contract non-renewal of a teacher who returned to work after taking maternity leave.

The union charges that Marist Brothers, not wanting to renew a contract which would have lead to a future unlimited term contract, unfairly ended the employment of the teacher - without any warnings - over what they claim to be the teachers "problems" at work.

Dear GU - Although I'm not a member (I live in Tokyo) I have been following your posts for a while. This is my sixth year of a one-year contract BUT I'm fortunate as my school has applied for a non-regular teaching license (教育職員特別免許) for me (awarded on Sep 1!) and plan to give me a tenured position from next year. Board of Education Illegally Denies Childcare Leave

Recently, the General Union received an e-mail from a worried JET at a Kanto area Board of Education. Married, the teacher is expecting her first child later in the year.

When she approached the Board of Education to ask about maternity and childcare leave, she was happy to learn that she could take maternity leave and that the Board of Education would help with documentation so that she could receive maternity leave allowance through shakai hoken (Employee Health and Pension Insurance; EHPI).

Hokkaido International School Unionizes

Last year we were approached by teachers at Hokkaido International School looking to unionize. Given that the company is located in Sapporo, and we could not legally enforce collective bargaining in Osaka, we decided it was best to find a local union.

Sapporo General Union (unrelated to General Union) does not actively seek foreign members but when we approached them they decided to take up HIS. It helped that there were potential members fluent in Japanese.

Doshisha: Final Warning Sent Over "Dues Checkoff" Demand

General Union members at Doshisha Kori Junior and Senior High School have been attempting to get their employer agree to a union "dues checkoff" system. This would allow union members to have their dues withdrawn directly from their monthly salaries.

Victory at Doshisha International Academy – More Successes to Follow?

In a major victory at Doshisha International Academy, the General Union has been able to overturn five-year contract limits for our members.

As of last April (2016), all of our members received contracts that had no limit on renewals. This had been a major demand of our union.

    Some kindergartens are better than others, and there are definitely good ones out there. However, in our experience, many kindergartens in the Kansai & Nagoya areas have problems of some sort or another. Wouldn't you like to be part of improving things?

    These are some of the problems we have dealt with at some kindergartens. How does your workplace compare?

    • Harassment
    • Unjustified firings
    • Unwillingness to enroll employees in unemployment insurance
    • Unwilling to enroll in , or illegally cut salaries to, Shakai hoken (health & pension as mandated by law)
    • Threats of reduced salary when asking to be enrolled in shakai hoken
    • Forced or unpaid overtime
    • Lack of real breaks
    • Lack of preparation time
    • Inability to use paid leave as you want (guaranteed by law)
    • Half of employee's paid leave being set by the employer (usually illegally)
    • Illegal salary deductions for taking sick days
    • Money being withheld illegally when resigning
