Osaka Gaigo's "Argument"

Back in early 2017, the General Union helped one of our members sue Osaka Gaigo Senmon Gakko over financial losses due to their failure to enroll him in Health & Pension Insurance (shakai hoken).

Although the case is currently ongoing, we thought you might be interested in what "The Gaigo" is claiming.

You can read it all in the pdf link, but here are some choice highlights...

• When hired, our member, was given an explanation of shakai hoken along with the option to enroll (despite the fact that we have a legal statement from the person in charge at that time stating that no foreign employees were allowed to join, or ever given an explanation).

• That even if the law was broken there are no damages to our member (even though his pension is significantly lower than it should be).

• If damages are to be awarded the plaintiff's portion of premiums (pension + health insurance) should be deducted from any damages awarded (despite the company never having paid their own portion and also claiming they hadn't broken the law).

Hearings continue, but we hope Osaka Gaigo realizes that it would have been cheaper to settle when we first tried to negotiate.
